This Privacy Policy (“Policy”) describes how Anima Virtuality, Inc. (“Anima,” “we,” or “us”) collects, uses, stores and shares your information when you visit https://only.bot (the “Site”) or download and use the Onlybots VMO iOS App or App Clip (the "app" and, together with the Site, the “Services”) as well as the choices you can make about how we may use such information. It is important that you take the time to read and understand this Policy so that you know how we use your personal information.  This Policy is incorporated by reference into our Terms of Services, currently available at https://only.bot/terms (the “Terms of Service”). Any terms used herin and not defined will have the meanings given to them in the Terms of Service.  By using the Services, you accept the terms of this Policy and our Terms of Service, and consent to our collection, use, disclosure, and retention of your information as described in this Policy, and that you are over 16 years of age. PLEASE DO NOT USE, INSTALL OR ACCES THE SERVICES IF YOU DO NOT AGREE TO THIS PRIVACY POLICY.

1.       What We Mean by Personal Information

For purposes of this Policy, “Personal Information” means any information from or about a person that either identifies that person directly or that makes that person identifiable when it is combined with other information from or about that person from any source, including but not limited to Device Information and App Device Information (each as defined below).

2.       INFORMATION WE COLLECT

Information You Provide to Us

When you use the Services or otherwise communicate with us, we collect information that you provide to us directly.  For example, we collect information in the following circumstances: you (i) use the app or visit the Site; (ii) access the Services through social networking sites or third party services; (iii) request technical support; (iv) otherwise use the app or online Services where Personal Information is required for such use and/or participation; and (v) when you contact us via the Site or when you otherwise communicate with us.  You can choose not to provide information that is requested of you by us; however, this may limit your ability to use or access the Services.

The information you provide to us directly may include, without limitation, the following information that may, alone or in combination with other data, constitute Personal Information:

·         Information you provide in connection with completing a transaction or purchase using the Services (including purchasing or identifying your Onlybot), including your Wallet, and any other information you decide to provide;

·         Information you provide via email, Discord or otherwise to contact us, including your name, e-mail, phone number, inquiry, Wallet or any other information you decide to provide;

·         If you are one of our customers, suppliers or prospects, we may process limited Personal Information in the course of our business relation with you, for example when you place an order, request a demo or vice versa. Such Personal Information may include your name, company, title, e-mail address, telephone number, address, order details, and where applicable and relevant, credit registrations and credit limits;

·         Information that you provide to interact with the interactive chat and other features associated with the Services, which may include Personal Information; and

·         Any other information you may want to share with us, such as Personal Information related to recruitment / job applications.

Moreover, if you contact us, a record of such correspondence may be kept. 

Additionally, if another user refers you to us by providing us with your e-mail address, we may send you a message.  However, we will use your e-mail address only to send such other user’s message unless you otherwise affirmatively provide your information to us.

Automatically Collected Information - Site

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device (see below for more information on cookies and related technologies). Additionally, as you browse the Site, we collect information about the individual web pages you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

Google Analytics is an element of the Site. By using cookies, Google Analytics collects and stores data such as time of visit, pages visited, time spent on each page of the Site, the Internet Protocol address, and the type of operating system used in the devices used to access the Site. By using a browser plugin available at http://www.google.com/ads/preferences/plugin/ provided by Google, you can opt out of Google Analytics.

How We Use Cookies and Other Technologies

Some of the features on the Site and the Services require the use of “cookies” - small text files that are stored on your device’s hard drive. We use cookies to measure which pages are being accessed, and which features are most frequently used. This enables us to continuously improve the Site to meet the needs of our visitors.

Functionality cookies

Functionality cookies allow our Sites to remember information you have entered or choices you make (such as your username, language, or your region) and provide enhanced, more personal features. These cookies can also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customize. We may use local shared objects, also known as Flash cookies, to store your preferences or display content based upon what you view on the Site to personalize your visit.

We and our service providers may also use “pixel tags,” “web beacons,” “clear GIFs,” or similar means in connection with the Services and HTML-formatted email messages to, among other things, track the actions of users, to determine the success of marketing campaigns and to compile aggregate statistics about Site usage and response rates.

Automatically Collected Information - The Onlybots VMO App

When you download and use the app, we will request and collect certain information about your device, including crash logs to create a more stable experience.

We do not store any of the above app-specific information connected to you personally in any way. We refer to this information as “App Device Information.”

Information You Share on Third Party Websites or through Social Media Services

The Services may include links to third party websites and social media services where you will be able to post comments, stories, reviews or other information. Your use of these third-party websites and social media services may result in the collection or sharing of information about you by these third party websites and social media services. We encourage you to review the privacy policies and settings on the third-party websites and social media services with which you interact to make sure you understand the information that may be collected, used, and shared by those third party websites and social media services.

TrueDepth API

The Services also make use of automatically collected information using the device camera and the TrueDepth API provided by Apple. The only use of this information is to apply control to the scene based on the user’s viewing position and orientation.. None of the information collected by the TrueDepth API ever leaves the user’s device, is shared with any third parties, or is persistently stored on the device.

3.       HOW DO WE USE YOUR INFORMATION?

We use your information to provide you with the Services, to comply with applicable law, to communicate with you, to improve our services, and with your consent.

We use your information as we determine is necessary in order to comply with applicable laws, rules, and regulations. This includes using your information to respond to lawful requests for such information, such as subpoenas, made by government authorities. This also includes potential use of your information to identify, protect against, or deter unauthorized or illegal activity.

We may also use your information to operate, maintain, and improve and optimize our Services (for example, by generating analytics about how our customers browse and interact with the Site and to assess the success of our marketing efforts) and to attempt to protect our users and collaborators from fraudulent purchases.

We use the App Device Information to look for bugs in our codebase that are causing crashes to fix them and provide a better experience for all users.

We may use or share your information with your consent, such as when you consent to let us post your testimonials or endorsements on our Sites, you instruct us to take a specific action with respect to your personal information, or you opt into third party marketing communications.

4.       HOW WE SHARE YOUR INFORMATION

We may share your Personal Information with third parties as follows:

·         Service providers, such as payment processors, web hosting and data storage service providers, and helping us deliver and develop the Services. data storage service providers, marketing service providers, and communications service providers (e.g. OpenAI, L.L.C and Microsoft Corporation);

·         Our advertising partners in compliance with applicable law;

·         Public authorities, such as law enforcement, if we are legally required to do so or if we need to protect our rights or the rights of third parties; and

·         Our subsidiaries and affiliates; or a subsequent owner, co-owner or operator of the Site and/or the Services and their advisors in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets, or in connection with bankruptcy proceedings, or other corporate reorganization, in accordance with this Privacy Policy.

We may share information with those who need it to do work for us. These recipients may include third party companies and individuals to administer and provide the Service on our behalf (such as customer support, hosting, email delivery, and database management services), as well as lawyers, bankers, auditors, and insurers.

5.       Links to Other Websites

We frequently make content or services from other websites available to you from links located on the Site. We may present links in a format that enables us to keep track of whether these links have been followed. This Policy applies only to the Site and the Services. We do not exercise control over third party services or other websites that provide information, or links from within the Site or the Services. Your interactions with these third-party services are governed by the privacy policy of the company providing it. These other sites and services may place their own cookies or other files on your computer’s browser, collect data or solicit Personal Information from you. Other websites and services follow different rules regarding the use or disclosure of the Personal Information that you submit, and the collection and use of such information and access of any third-party websites are subject to such third party’s privacy policy. We encourage you to read the privacy policies and other terms of such third parties before using their services.

6.       HOW WE STORE AND SECURE YOUR INFORMATION

We retain information we collect as long as it is necessary and relevant to fulfill the purposes set forth in this Policy. In addition, we retain information in order to comply with applicable law where required, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service, and other actions permitted by law.

We employ industry standard security measures designed to protect the security of all information submitted through the Services. However, the security of information transmitted through the internet can never be guaranteed. We are not responsible for any interception or interruption of any communications through the internet or for changes to or losses of data. In order to protect you and your data, we may suspend your use of any of the Services, without notice, pending an investigation, if any breach of security is suspected.

7.       YOUR CHOICES REGARDING INFORMATION

Update or delete. As we do not connect Device Information or App Device Information back to an account, we cannot update or delete information specific to a person (as we do not know whose information it is).

Online tracking opt out - blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.

We do not use any to provide you with targeted advertisements. Accordingly, we have disabled ad tracking and user profiling within Google Analytics. In the event that we enable these features in the future, you can opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout. From this tool you can also exercise choices regarding the use of cookies from Google Analytics.

Do Not Track: Please note that we do not alter our Site or App's data collection and use practices when we see a Do Not Track signal from your browser or device. To find out more about "Do Not Track," please visit http://www.allaboutdnt.com.

This section provides additional details about the personal information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA.”

For more details about the personal information we collect from you, please see the “Information We Collect” section above which sets for the categories of information we collect and the specific pieces of information collected. We collect this information for the business and commercial purposes described in the “How We Use Your Information” section above. We share this information with the categories of third parties described in the “How We Share Your Information” section above. We do not sell (as such term is defined in the CCPA) any information we collect (and would not sell it without providing a right to opt out). Please refer to the section above titled “Information We Collect” for more information regarding the types of third-party cookies, if any, that we use.

Subject to certain limitations, the CCPA provides California consumers the following rights:

 to request more details about the categories or specific pieces of personal information we collect (including how we use and disclose this information),

to delete their personal information,

 to opt out of any “sales” of information that may be occurring, and

 to non-discrimination for exercising these rights.

NOTICE TO EU RESIDENTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. However, we do not collect any personal information.

With respect to EU data subjects, “personal information,” as used in this Privacy Policy, is equivalent to “personal data” as defined in the European Union General Data Protection Regulation (GDPR).

You may make a request pursuant to any rights by contacting us at support@anima.supply. Please note that we may require you to complete an identity verification and to verify any such request before we process the request. We also may decline a request when permitted or required by law.

MINORS

While we allow children and young teenagers to use our Services, only parents, legal guardians, or other adults are allowed to make purchases through our Services and children under 16 are not authorized to make use of our Services. 

With proper authentication, a parent or legal guardian always has the right to review the Personal Information we may have collected and stored about their child, request deletion of such Personal Information, or refuse to allow further collection or use of such information by us. Please keep in mind that a request to delete such information may limit your or the child’s access to all or a portion of the Services. If you believe that a child under 18 might have provided us with Personal Information without your permission, or if you wish to view, request deletion of, or prohibit further collection of information about your child, please contact us at support@anima.supply. We urge parents to monitor their children’s use of all digital media.

We may share Device Information or App Device Information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.

We may share information with those who need it to do work for us.
